Terms & Conditions

Disclaimer: The French Terms and Conditions are legally binding, whereas the English translation of these Terms and Conditions are a courtesy service.

Article 1: Definitions

1.1 Serge Yoga club is the user of the stated terms and conditions.

1.2 Client: The party who purchases a product or service from Serge Yoga Club.

Article 2: Applicability and Validity

2.1 These general terms and conditions apply to all agreements wherein Serge Yoga Club is the acting contractor.

2.2 These general terms and conditions also apply to the free trial offer when relevant.

2.3 Agreements concerning deviations from the stated terms and conditions are only valid when they are confirmed by Serge Yoga Club in writing.

2.4 If at any time one or more of the provisions of the stated terms and conditions become wholly or partially invalid, or become void, then the remainder of these terms and conditions will continue to be fully applicable.

Article 3: Free trials & conditions of the "monthly channel videos product"

3.1.1 Free trials are for 7 consecutive days and constitutes a subscription

3.1.2 Free trials allow access to all the videos library that are available within the monthly memberships product

3.1.3 Only 1 free trial is permitted per person.

3.2 Monthly subscriptions are automatically renewed every month. You will receive a monthly invoice via email

3.3 A subscription can start at any time of the month. A monthly subscription is valid up to one month respectively, starting from the agreed upon date.

3.4 You can cancel your monthly subscription at any time by sending an email to namaste@sergeyogaclub.com. Your subscription will end the day of your subscription anniversary date. A month started is therefore due fully.

3.5 Serge Yoga Club does not refund memberships.

Article 4: Conditions of the livestream classes

4.1 A live-stream class can be bought as a single class or a package of 5 classes valid 60 days

4.2 The lesson schedule can be found on the online page. The schedule is subject to changes and modifications by Serge’s Yoga Club. Serge’s Yoga Club reserves the right to cancel lessons. Changes in the schedule do not entitle the client to a refund or renewal of already-purchased memberships.

4.3 The live-stream classes start on time, a student joining the waiting room after the start of the class is not guaranteed to participate

Article 5 : conditions of the “private class “ product

5.1 A private live-stream class can be bought as a single class

5.2 Serge’s yoga club and the client agree on a time slot of 60 minutes

5.3 A private class required 48 hours’ notice of cancellation for all appointments

5.4 A session not rescheduled or cancelled 48 hours in advance will result in forfeiture of the session and a loss of the financial investment at the rate of one session.

5.5 Clients arriving late will receive the remaining scheduled session time, unless other arrangements have been previously made with Serge yoga club.

5.6 If Serge yoga club is late, additional time will be added to the session or to subsequent sessions

Article 6: Conditions of the classes in malmousque

6.1 An outdoor class at Malmousque can be bought as a single class or a package of 5 classes valid 60 days

6.2 The lesson schedule can be found on yoga in Malmousque page. The schedule is subject to changes and modifications by Serge Yoga Club. Serge Yoga Club reserves the right to cancel lessons. Changes in the schedule do not entitle the client to a refund or renewal of already-purchased package.

6.3 If a class is canceled the credit of the class is not refunded and can be used for another class

6.4 You can book up to 5 people for the same class with 1 package of 5 classes

6.5 The yoga in Malmousque classes start on time

Article 7: House Rules

7.1 The Client must always follow the house rules, as stated by Serge Yoga Club:

Serge Yoga Club would like to provide every Client with an optimal experience.

The integrity of our Clients and employees is to be respected at all times. Sexual harassment and inappropriate behaviour will not be tolerated by Serge Yoga Club.

Article 8 : Obligations to be upheld by Serge Yoga Club

8.1 Serge Yoga Club reserves the right to refuse participation to any Client who, in the opinion of Serge Yoga Club, does not abide by the house rules as stated in Article 7. Payment obligations of the Client who has been refused participation by Serge Yoga Club remain unaffected.

8.2 The admission of a Client to a product, lesson, course, workshop or training on the basis of meeting the admission requirements does not guarantee that the Client will successfully complete the lesson, course, workshop or training. The live-stream classes start on time, a student joining the waiting room after the start of the class is not guaranteed to participate.

8.3 Serge Yoga Club reserves the right to cancel a lesson, course, workshop or training without stating the reason thereof. Serge Yoga Club reserves the right to refuse participation to any Client prior to the start of a lesson, course, workshop or training, without stating the reason thereof.

8.4 Serge Yoga Club is under no obligation to repeat the offered courses and / or training to Clients who were unable to attend. The payment in full of missed courses and/ or training remains the obligation of the Client.

Article 9: Pricing and Payment

9.1 All prices are stated in Euro, the VAT is not applicable.

9.2 Serge Yoga Club reserves the right to change the prices on all services offered. New pricing will be communicated through the products pages

9.3 Serge Yoga Club may increase the pricing of their services without notice. The Client will only be responsible for complying with the price increase on not-yet purchased services. All services purchased at the lower price are not subject to the price increase.

9.4 Serge Yoga Club is entitled to suspend its contractual obligations toward the Client when the Client fails to make a payment or makes an incomplete payment towards any service offered by Serge Yoga Club. In case of Client’s failure to pay, Serge Yoga Club reserves the right to refuse the Client access to its premises and is furthermore entitled to terminate any agreement made between the Client and Serge Yoga Club. Serge Yoga Club also reserves the right to dun the Client in case of failed, late or incomplete payments.

Article 10 : Force Majeure

10.1 Definition of Force Majeure: Events taking place outside the direct influential sphere of Serge Yoga Club, or any unforeseen circumstances which temporarily or permanently prevent Serge Yoga Club from fulfilling its obligations toward the Client. Such circumstances include: restrictive government measures, mobilisation, war, threat of war, revolution, strikes, seizure of property, confiscation of property, extreme weather conditions, natural disasters, lack of transportation methods, the defaulting of a third party whose services have been commissioned by Serge Yoga Club.

10.2 In case of force majeure, Serge Yoga Club reserves the right to suspend its obligations towards the Client without judicial intervention and without obligation to pay any total or partial compensation to the Client, at the discretion of Serge Yoga Club.

Article 11 : Liability

11.1 The purchase of services offered by Serge Yoga Club is at the Client’s own risk. If the Client is in doubt about the condition of their health, It is advisable to consult a medical professional. The Client is obliged to report any compromising health or other physical/mental conditions (eg. pregnancy, high blood pressure, glaucoma, muscle or joint pain, brain concussion, etc) to the teachers. The Client is advised to interrupt the activity in the event of discomfort and warn the teacher or therapist thereof.

11.2 Serge Yoga Club is not liable for any material or immaterial damages resulting from accident or injury to the Client on Serge Yoga Club premises.

11.3 Serge Yoga Club is not liable for loss, embezzlement, theft or damage to the Client or the Client’s property, whether direct or indirect.

11.4 Intentional or unintentional damage caused to the property of Serge Yoga Club by improper use of the Client should be duly compensated by the Client.

11.5 Client cannot indemnify any third parties working in conjunction with Serge Yoga Club: employees, third-party contractors and employees of said third-party contractors hired by Serge Yoga Club are never liable to a Client’s indemnification.

Article 12 : Suspension and Termination

If at the time of delivery of services it is found that the Client does not properly comply with their obligations toward Serge Yoga Club in terms of payment and house rules, Serge Yoga Club reserves the right to suspend or terminate all agreements made with the Client. Suspension of agreements are to be made at Serge Yoga Club discretion without any notice or judicial intervention and without being obliged to pay any compensation to the Client, whole or partial, and without liability on the part of Serge Yoga Club.

Article 13 : Changes to Terms

Serge Yoga Club reserves the right, in its sole discretion, to change the Terms under which the Yoga Club is offered. The most current version of the Terms will supersede all previous versions. Serge Yoga Club encourages you to periodically review the Terms to stay informed of our updates.
